DTM makes false accusations relating to EOS

On July 12th 1996 DTM Corporation of Austin, Texas, published a press release
proclaiming that the "European Patent Office makes ruling in DTM/EOS patent
dispute". Both the headline and the contents of this press release were
completely untrue.

The European Patent Office (EPO) has not made any ruling relating to the
opposition by EOS GmbH to the European Patent 0287657. The opposition is
currently being processed in the normal way by the EPO, the only actions to date
being the opposition by EOS, a response to the EPO by DTM and a communication of
provisional opinion by the Opposition Division of the EPO. Oral proceedings to
discuss the opposition have been requested by both parties but no date has yet
been set by the EPO. EOS and its patent attorneys believe that the patent is
invalid and should be withdrawn as a result of the opposition.

The further claim by DTM that "the Court also ruled that the DTM patent ...
meets all of the requirements of the EPO" is also untrue. No court has made any
ruling relating to the validity of the patent in question, indeed no court has
even considered this matter.

As a party to this opposition case DTM is informed by the EPO of all
developments and must therefore be fully aware that their press release
represents a gross distortion of the truth. With this press release EOS
expressly warns DTM Corporation to immediately cease making such false
statements. EOS is further considering legal action against DTM regarding the
use of unfair and illegal competition tactics.
